Family Advisor

The South Dakota Family Advisor is a unique planning tool that provides settlors of trusts, beneficiaries, and their advisors with greater direction and control over important aspects of trust administration when used in conjunction with a Directed Trust.

South Dakota is the only state in the nation to have enacted legislation statutorily recognizing the Family Advisor, further distinguishing its modern trust laws from those of every other U.S. trust jurisdiction.

Similar to a Trust Protector, but serving exclusively in a non-fiduciary capacity, the South Dakota Family Advisor has the ability to advise, participate in, and provide direction on many important aspects of trust administration without elevating the position to that of a fiduciary or assuming the heightened duties and potential liability that may otherwise deter trusted advisors from serving. Often referred to as a “Trust Protector Light,” the Family Advisor can be an excellent option for families who want a trusted attorney, CPA, or investment advisor to remain actively involved in the trust while preserving clearly defined responsibilities for each participant.
